{"id":2163,"date":"2026-05-14T02:51:58","date_gmt":"2026-05-14T02:51:58","guid":{"rendered":"https:\/\/fordhamlawelr.org\/?p=2163"},"modified":"2026-05-14T02:51:58","modified_gmt":"2026-05-14T02:51:58","slug":"small-reactor-big-impact-responsibly-utilizing-small-modular-reactors","status":"publish","type":"post","link":"https:\/\/fordhamlawelr.org\/?p=2163","title":{"rendered":"Small Reactor, Big Impact: Responsibly Utilizing Small Modular Reactors"},"content":{"rendered":"\n<p>Dhara P., ELR Staffer, Class of 2028<\/p>\n\n\n\n<p><a href=\"https:\/\/www.iaea.org\/bulletin\/driving-deeper-decarbonization-with-nuclear-energy\">Fossil fuels<\/a> continue to dominate the world\u2019s energy use and <a href=\"https:\/\/www.epa.gov\/ghgemissions\/sources-greenhouse-gas-emissions\">greenhouse gases (GHG) emissions<\/a>. <a href=\"https:\/\/www.iaea.org\/bulletin\/driving-deeper-decarbonization-with-nuclear-energy#:~:text=If%20we%20miss,planet%20becoming%20uninhabitable.\">Climate experts warn<\/a> that if fossil fuels continue to dominate the energy market, we could experience <a href=\"https:\/\/www.iaea.org\/bulletin\/driving-deeper-decarbonization-with-nuclear-energy#:~:text=If%20we%20miss,planet%20becoming%20uninhabitable.\">catastrophic climate outcomes<\/a> beyond sea level rise, extreme heatwaves, or the elimination of critical species; entire regions of the planet may become entirely uninhabitable. One of the main goals outlined in the <a href=\"https:\/\/unfccc.int\/sites\/default\/files\/english_paris_agreement.pdf\">Paris Agreement<\/a> is to limit global temperature from climbing 1.5 to 2\u00b0C by 2050. To achieve this goal, the <a href=\"https:\/\/treaties.un.org\/Pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=XXVII-7-d&amp;chapter=27&amp;clang=_en\">194 parties <\/a>to the Paris Agreement must <a href=\"https:\/\/emp.lbl.gov\/news\/50-reduction-emissions-2030-can-be#:~:text=According%20to%20a%20study%20published%20in%20*Science*%2C,response%20between%20states%20and%20the%20federal%20government**\">decrease GHG emissions by 50% or more<\/a>. Nuclear energy plays a key role in reducing and eliminating human-caused carbon dioxide\u2014known as <a href=\"https:\/\/www.iaea.org\/bulletin\/driving-deeper-decarbonization-with-nuclear-energy\">decarbonization<\/a>\u2014and <a href=\"https:\/\/www.iaea.org\/newscenter\/news\/repurposing-fossil-fuel-power-plant-sites-with-smrs-to-ease-clean-energy-transition\">transitioning away from fossil fuels<\/a>.<\/p>\n\n\n\n<p>Nuclear power contributes to over <a href=\"https:\/\/world-nuclear.org\/information-library\/current-and-future-generation\/nuclear-power-in-the-world-today#:~:text=Nuclear%20provides%20over%2020%25%20of%20the%20world%E2%80%99s%20low%2Dcarbon%20electricity.\">20% of low-carbon electricity generation<\/a> worldwide and about <a href=\"https:\/\/world-nuclear.org\/information-library\/current-and-future-generation\/nuclear-power-in-the-world-today#:~:text=9%25%20of%20the%20world%27s%20electricity%20from%20about%20440%20power%20reactors.\">9% of the world\u2019s total energy generation<\/a>. The United States <a href=\"https:\/\/www.eia.gov\/todayinenergy\/detail.php?id=65904\">leads the world\u2019s nuclear electricity generation<\/a>, with <a href=\"https:\/\/www.eia.gov\/todayinenergy\/detail.php?id=65104\">94<\/a> commercial, large-scale nuclear reactors in operation as of February 2025.&nbsp;<\/p>\n\n\n\n<p>While large-scale reactors are widely <a href=\"https:\/\/world-nuclear.org\/information-library\/nuclear-power-reactors\/small-modular-reactors\/small-modular-reactors#:~:text=Large%2Dscale%C2%A0reactors%C2%A0provide%20reliable%2C%2024\/7%20electricity%20supply%20on%20a%20low%20cost%2Dper%2Dunit%20basis%2C%20ideal%20for%20most%20on%2Dgrid%20applications.%C2%A0High%20upfront%20capital%20costs%20are%20followed%20by%C2%A0exceptionally%C2%A0low%20and%20stable%20operational%20costs%2C%20meaning%20it%C2%A0generally%20makes%C2%A0sense%20to%C2%A0operate%C2%A0large%20reactors%C2%A0continuously\">reliable for the energy grid<\/a>, they also <a href=\"https:\/\/www.usitc.gov\/publications\/332\/working_papers\/smrs_fo_ma.pdf\">consume large amounts of water for cooling, require regular radioactive waste management, and warrant complex decommissioning and remediation if the site shuts down<\/a>. Traditional large-scale reactors are static assets; <a href=\"https:\/\/www.usitc.gov\/publications\/332\/working_papers\/smrs_fo_ma.pdf\">many large reactors are strategically located<\/a> in areas with adequate demand for clean energy, grid capacity, and physical space to accommodate the size of the reactor(s).&nbsp;<\/p>\n\n\n\n<p>With the increasing demand for clean energy and the availability of nuclear power across a variety of economies, government-funded research and development, combined with private investment, have led to the development of <a href=\"https:\/\/world-nuclear.org\/information-library\/nuclear-power-reactors\/small-modular-reactors\/small-modular-reactors#:~:text=SMR%20development%20is,carbon%20dioxide%20emissions.\">small modular reactors<\/a> (SMRs). The <a href=\"https:\/\/www.nrc.gov\/about-nrc\/governing-laws\/advance-act\/about-advance-act\">ADVANCE Act<\/a>, signed into law in July 2024, requires the Nuclear Regulatory Commission to reduce licensing fee burdens, increase staffing for efficient reviews, and leverage the <a href=\"https:\/\/www.energy.gov\/ne\/advanced-small-modular-reactors-smrs#:~:text=U.S.%20Industry%20Opportunities%20for%20Advanced%20Nuclear%20Technology%20Development%C2%A0\">Department of Energy to incentivize prototype development.<\/a>&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.energy.gov\/ne\/benefits-small-modular-reactors-smrs?utm_source=chatgpt.com\">SMRs<\/a> are designed for areas with smaller grids, water insecurity, and limited acreage that cannot fit traditional large reactors. <a href=\"https:\/\/www.nei.org\/news\/2020\/nuclear-solution-for-climate-energy-water\">SMRs generally use less water<\/a> from communities than traditional large reactors, which underscores their need in communities that experience water shortages. Though SMRs boast a smaller water-use footprint, a <a href=\"https:\/\/www.theenergymix.com\/small-modular-nukes-produce-more-radioactive-waste-than-traditional-ones-study-finds\/?utm_source=chatgpt.com#:~:text=A%20new%20study%20finds%20that%20mini%2Dnuclear%20power%20stations%20produce%20higher%20volumes%20of%20radioactive%20waste%20per%20unit%20of%20generation%20than%20larger%2Dscale%20traditional%20ones.\">Stanford study<\/a> showed that SMRs may produce higher volumes of radioactive waste per unit of energy generated than large reactors.&nbsp;<\/p>\n\n\n\n<p>SMRs may fill the gap for communities that have difficulty accessing nuclear power from traditional large reactors. SMRs, as the name suggests, are <a href=\"https:\/\/www.iaea.org\/newscenter\/news\/what-are-small-modular-reactors-smrs\">modular<\/a>: they can be shipped<a href=\"https:\/\/www.usitc.gov\/publications\/332\/working_papers\/smrs_fo_ma.pdf\"> from the manufacturer to the site<\/a> and subsequently installed <a href=\"https:\/\/www.energy.gov\/ne\/benefits-small-modular-reactors-smrs?utm_source=chatgpt.com\">without the lengthy construction<\/a> logistics required for large reactors. SMRs have <a href=\"https:\/\/restservice.epri.com\/publicdownload\/000000003002026582\/0\/Product\">lower total project costs<\/a> than large reactors, though the <a href=\"https:\/\/www.globsec.org\/what-we-do\/commentaries\/faster-cheaper-smarter-promise-and-pitfalls-small-modular-reactors\">cost per kilowatt of energy is higher<\/a>. Thus, SMRs are considered more <a href=\"https:\/\/www.iaea.org\/newscenter\/news\/what-are-small-modular-reactors-smrs\">affordable, efficient, customizable, and mobile<\/a> compared to traditional large reactors. <a href=\"https:\/\/www.energy.gov\/ne\/benefits-small-modular-reactors-smrs?utm_source=chatgpt.com\">Industries reliant on fossil fuels<\/a> may leverage SMRs by <a href=\"https:\/\/www.iaea.org\/publications\/15098\/nuclear-renewable-hybrid-energy-systems\">integrating <\/a>them with<a href=\"https:\/\/www.naes.com\/how-small-modular-reactors-smrs-impact-the-electrical-grid\/#:~:text=Seamless%20Integration%20with,critical%20infrastructure%20sites.\"> other renewable sources<\/a> or with fossil fuels, optimizing energy production and <a href=\"https:\/\/www.iaea.org\/publications\/15098\/nuclear-renewable-hybrid-energy-systems\">making it easier for them to move towards cleaner energy sustainably<\/a>.&nbsp;<\/p>\n\n\n\n<p>However, <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629625005389#bb0010\">gaps<\/a> in the implementation of SMRs persist. Environmental justice scholars argue that, though SMRs offer many benefits, there are still <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629625005389#bb0010\">energy justice blind spots<\/a> to address. <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629625005389#bb0010\">Federal governments or large corporations<\/a> typically drive policies and shape SMR design. The <a href=\"https:\/\/www.nrc.gov\/reactors\/new-reactors\/advanced\">federal government<\/a> primarily oversees SMR implementation through policy agendas and <a href=\"https:\/\/www.nrc.gov\/reading-rm\/doc-collections\/cfr\/part050\/index\">regulations<\/a> on construction, operations, and design certificates. As a product of this <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0301421523000162#:~:text=Following%20similar%20technocratic,under%20old%20paradigms.\">\u201ctop-down\u201d approach<\/a>, systemically <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/14631377.2021.1943917\">marginalized groups<\/a>\u2013like <a href=\"https:\/\/wires.onlinelibrary.wiley.com\/doi\/full\/10.1002\/wene.498\">indigenous communities\u2013 <\/a>often remain excluded from energy conversations, especially those about renewable energy. When governments and corporations exclude these communities from the conversation, they fail to acknowledge the <a href=\"https:\/\/link.springer.com\/article\/10.1007\/s10584-019-02521-7#:~:text=recognition%20justice%20focuses,fears%20of%20reprisal\">sidelining of their cultures and rights<\/a>.&nbsp;<\/p>\n\n\n\n<p>Furthermore, marginalized communities have historically <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0301421523000162\">disproportionately borne the environmental and health risks<\/a> from nearby radioactive waste disposal sites and uranium mining <a href=\"https:\/\/www.scopus.com\/pages\/publications\/85144841576\">without equitable access to the energy generated<\/a>. Integrating SMRs without community input sparks apprehension about <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/2154896X.2023.2274264#d1e165\">resource control and community consent<\/a>. Unlike traditional nuclear power plants, which require around-the-clock staff, <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629625005389#bb0010\">SMR plants require less staff for maintenance and operations<\/a>. SMRs present concerns that switching from traditional power plants to SMRs would reduce demand for local employment opportunities.&nbsp;<\/p>\n\n\n\n<p>Though SMRs may have a smaller environmental footprint and lower start-up costs than traditional large reactors, concerns are rising that <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629625005389#bb0010\">reducing the financial risk to deploy these reactors, coupled with complex regulations and safety standards<\/a>, will overwhelm regulators and cause them to overlook the negative effects these reactors have on communities in the name of energy efficiency, leading to <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629625005389#bb0010\">fragmented accountability<\/a>.&nbsp;<\/p>\n\n\n\n<p>Whether it is a traditional nuclear power plant or an SMR, implementers should focus on <a href=\"https:\/\/news.engin.umich.edu\/2025\/12\/new-nuclear-requires-strong-governance-to-avoid-making-old-mistakes\/?utm_source=chatgpt.com#:~:text=Worker%20training%20programs%20to%20ensure%20that%20local%20people%20benefit%20economically%20from%20nearby%20nuclear%20sites\">creating jobs locally,<\/a> promoting equitable community <a href=\"https:\/\/news.engin.umich.edu\/2025\/12\/new-nuclear-requires-strong-governance-to-avoid-making-old-mistakes\/?utm_source=chatgpt.com#:~:text=Engaging%20local%20communities%20around%20nuclear%20sites%20to%20negotiate%20consent%20and%20benefits%20such%20as%20discounted%20electricity%20rates%20and%20formal%20profit%20sharing%20agreements\">consent and resource control<\/a> through <a href=\"https:\/\/www.emerald.com\/ijccsm\/article-pdf\/16\/1\/44\/9476447\/ijccsm-04-2023-0057.pdf\">community engagement<\/a>, and providing <a href=\"https:\/\/news.engin.umich.edu\/2025\/12\/new-nuclear-requires-strong-governance-to-avoid-making-old-mistakes\/?utm_source=chatgpt.com#:~:text=Limiting%20private%20funding%20and%20foreign%20investment%20so%20that%20influence%20over%20the%20project%20stays%20local%20and%20democratic\">loans or grants to projects that prioritize serving marginalized communities<\/a>. While SMRs offer <a href=\"https:\/\/stpp.fordschool.umich.edu\/research\/research-report\/reactor-around-corner-understanding-advanced-nuclear-energy-futures#:~:text=Governments%2C%20industries%2C%20and%20publics%20have%20shown%20increasing%20interest%20in%20SMRs%20and%20other%20advanced%20reactors%20as%20central%20to%20solving%20the%20world%E2%80%99s%20energy%20crisis%20and%20have%20been%20supporting%20their%20rapid%20development.\">a promising avenue for decarbonization<\/a>, <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0301421524000624\">energy justice principles<\/a> should guide the design, deployment, and operation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dhara P., ELR Staffer, Class of 2028 Fossil fuels continue to dominate the world\u2019s energy use and greenhouse gases (GHG) emissions.
