{"id":2145,"date":"2026-04-21T21:37:01","date_gmt":"2026-04-21T21:37:01","guid":{"rendered":"https:\/\/fordhamlawelr.org\/?p=2145"},"modified":"2026-04-21T21:39:10","modified_gmt":"2026-04-21T21:39:10","slug":"new-yorks-environmental-law-reform-striking-the-right-balance-between-environmental-protection-and-housing-development","status":"publish","type":"post","link":"https:\/\/fordhamlawelr.org\/?p=2145","title":{"rendered":"New York\u2019s Environmental Law Reform &#8211; Striking the Right Balance Between Environmental Protection and Housing Development"},"content":{"rendered":"\n<p>Joseph Zarif, Fordham University School of Law (Class of 2027), Environmental Law Review Staffer<\/p>\n\n\n\n<p>In January of this year, New York Governor Kathy Hochul\u2019s administration announced its <a href=\"https:\/\/www.governor.ny.gov\/news\/let-them-build-governor-hochul-unveils-landmark-reforms-cut-red-tape-and-build-more-housing\">\u201cLet them Build\u201d reform<\/a>, a self-proclaimed \u201ccommon sense\u201d reform to help ease and <a href=\"https:\/\/www.6sqft.com\/hochul-moves-to-reform-environmental-law-to-speed-up-housing-construction\/\">speed up the construction of housing<\/a>. These changes come with the state government\u2019s broader mission of helping expedite projects that <a href=\"https:\/\/www.6sqft.com\/hochul-moves-to-reform-environmental-law-to-speed-up-housing-construction\/\">help communities build<\/a>. The reforms are an attempt to address the fact that housing, energy, and manufacturing projects, according to Hochul, have taken <a href=\"https:\/\/www.6sqft.com\/hochul-moves-to-reform-environmental-law-to-speed-up-housing-construction\/\">up to 56% longer<\/a> than in other states to move from conceptualization to the groundbreaking stage.\u00a0<\/p>\n\n\n\n<p>The Governor\u2019s agenda hones in on the <a href=\"https:\/\/dec.ny.gov\/regulatory\/permits-licenses\/seqr\">1975 New York State Environmental Quality Review Act (SEQRA)<\/a>, a major environmental statute in the state. SEQRA implements what many, including Hochul, recognize as an <a href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/kathy-hochul-new-york-let-them-build-housing-plan\/\">outdated, lengthy, and costly process that delays construction for years<\/a> by forcing government agencies to assess the environmental impacts of new housing developments. <a href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/kathy-hochul-new-york-let-them-build-housing-plan\/\">Developers have complained<\/a> for years about the obstacles that the regulatory framework puts in place, which do not provide environmental benefits in many cases. These hurdles <a href=\"https:\/\/www.6sqft.com\/hochul-moves-to-reform-environmental-law-to-speed-up-housing-construction\/\">increase the costs of building housing units<\/a>\u2013only worsening the housing crisis faced by the state. Developers\u2019 concerns, combined with the undeniable <a href=\"https:\/\/www.6sqft.com\/hochul-moves-to-reform-environmental-law-to-speed-up-housing-construction\/\">NY state crisis of housing shortage<\/a>, have ushered in the \u201cLet them Build\u201d agenda\u2019s changes to one of NY state\u2019s most important environmental statutes.<\/p>\n\n\n\n<p>As mentioned, SEQRA has caught certain <a href=\"https:\/\/www.6sqft.com\/hochul-moves-to-reform-environmental-law-to-speed-up-housing-construction\/\">\u201ccritical projects\u201d<\/a> that have not actually been found to pose <a href=\"https:\/\/www.governor.ny.gov\/news\/let-them-build-governor-hochul-unveils-landmark-reforms-cut-red-tape-and-build-more-housing\">adverse environmental impacts<\/a> in delays and red tape. Hochul\u2019s SEQRA reforms keep intact <a href=\"https:\/\/www.realtor.com\/news\/real-estate-news\/kathy-hochul-new-york-let-them-build-housing-plan\/\">various state regulatory and permit requirements<\/a> on projects which govern air quality, environmental justice, protection of natural resources, water use, and local zoning and other permitting requirements. The recent series of reforms attempts to balance the interests of environmental protection policy with lowering costs and development to ease the city\u2019s housing crisis.&nbsp;<\/p>\n\n\n\n<p>The SEQRA reform at hand here shows how states attempt to reconcile environmental protection with affordable housing development.
