{"id":1110,"date":"2021-01-20T23:39:19","date_gmt":"2021-01-20T23:39:19","guid":{"rendered":"https:\/\/news.law.fordham.edu\/elr\/?p=1110"},"modified":"2021-01-20T23:39:19","modified_gmt":"2021-01-20T23:39:19","slug":"the-lasting-effects-of-redlining-on-new-york-city-residents","status":"publish","type":"post","link":"https:\/\/fordhamlawelr.org\/?p=1110","title":{"rendered":"The Lasting Effects of Redlining on New York City Residents"},"content":{"rendered":"<p><a href=\"https:\/\/news.law.fordham.edu\/elr\/2021\/01\/20\/the-lasting-effects-of-redlining-on-new-york-city-residents\/screen-shot-2021-01-20-at-6-38-34-pm\/\" rel=\"attachment wp-att-1112\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-1112\" src=\"https:\/\/news.law.fordham.edu\/elr\/wp-content\/uploads\/sites\/12\/2021\/01\/Screen-Shot-2021-01-20-at-6.38.34-PM-300x193.png\" alt=\"\" width=\"300\" height=\"193\" \/><\/a><\/p>\n<p>by Blake Michael, Associate Online Editor, Fordham Environmental Law Review Journal<\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/perma.cc\/ZWW9-ZG8M\"><span style=\"font-weight: 400;\">Federal Reserve<\/span><\/a><span style=\"font-weight: 400;\"> defines redlining as \u201cthe practice of denying a creditworthy applicant a loan for housing in a certain neighborhood even though the applicant may otherwise be eligible for the loan\u201d. The term is a \u201c<\/span><a href=\"https:\/\/perma.cc\/R4WT-5LFU\"><span style=\"font-weight: 400;\">nod to how lenders identified and referenced neighborhoods with a greater share of people deemed more likely to default on mortgage. Using red ink, lenders outlined on paper maps the parts of a city that were considered at high risk of default, as well as more desirable neighborhoods for approving a loan. Riskier neighborhoods were predominantly black and Latino<\/span><\/a><span style=\"font-weight: 400;\">.\u201d Due to a general lack of funding, communities began to crumble and segregated neighborhood lines became even stronger.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Though redlining originated back in the 1930s, and has since been declared by courts to be an <\/span><a href=\"https:\/\/perma.cc\/4PGA-TWUR\"><span style=\"font-weight: 400;\">illegal racist practice<\/span><\/a><span style=\"font-weight: 400;\">,\u00a0 its lasting impacts can still be seen in cities across the country, including New York. In 2018, the <\/span><a href=\"https:\/\/perma.cc\/9AFL-LZXR\"><span style=\"font-weight: 400;\">New Economy Project<\/span><\/a><span style=\"font-weight: 400;\"> reported that banks and other mortgage lenders were significantly more likely to deny loan applications as the percentage of black or Latino residents in the New York City Neighborhoods increased.\u00a0 The organization also published a series of <\/span><a href=\"https:\/\/perma.cc\/W2ZT-WN9P\"><span style=\"font-weight: 400;\">maps<\/span><\/a><span style=\"font-weight: 400;\"> that highlight banks\u2019 failure to locate branches in communities of color. Their <\/span><a href=\"https:\/\/perma.cc\/K3NU-USDR\"><span style=\"font-weight: 400;\">research<\/span><\/a><span style=\"font-weight: 400;\"> found that banks and other mortgage lenders denied black applicants more than twice as often as white applicants (26% over 12%). Further, there are similar denial rate disparities for New Yorkers looking to refinance an existing mortgage (lenders deny 53% of black, 44% of Latino, and 40% of Asian New Yorkers, compared to 30% of white New Yorkers).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is easy to see the lasting effects of redlining in the visible segregation of New York\u2019s public schools. According to Matthew F. Delmont, author of <\/span><i><span style=\"font-weight: 400;\">Why Busing Failed; Race, Media, and the National Resistance to School Desegregation<\/span><\/i><span style=\"font-weight: 400;\">, \u201c<\/span><a href=\"https:\/\/perma.cc\/M4UF-9TDV\"><span style=\"font-weight: 400;\">school segregation worked hand in glove with mortgage redlining<\/span><\/a><span style=\"font-weight: 400;\">.\u201d Even in places where school segregation was not mandatory, it became common practice because school boards were able to draw strict boundaries to replicate the existing residential segregation.\u00a0 Today, the New York City public school system is one of the most segregated public-school systems in the country. \u201c<\/span><a href=\"https:\/\/perma.cc\/2DRX-KZQM\"><span style=\"font-weight: 400;\">Of the 1.1 million NYC public school students, 15% are white. However, about 75% of Black and Hispanic students attend schools where fewer than 10% of students are white,<\/span><\/a> <a href=\"https:\/\/perma.cc\/V8A5-44R9\"><span style=\"font-weight: 400;\">and about 35% of white students attend schools where more than half of the student population is also white<\/span><\/a><span style=\"font-weight: 400;\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/perma.cc\/98T9-C4YF\"><span style=\"font-weight: 400;\">Community Reinvestment Act of 1977<\/span><\/a><span style=\"font-weight: 400;\"> was an attempt to \u201c<\/span><a href=\"https:\/\/perma.cc\/E7BG-LXGX\"><span style=\"font-weight: 400;\">redress inequity by making sure banks served poor neighborhoods and faced consequences if they didn\u2019t\u2019<\/span><\/a><span style=\"font-weight: 400;\">.\u201d However, &#8220;<\/span><a href=\"https:\/\/perma.cc\/H9Q9-4SYF\"><span style=\"font-weight: 400;\">these laws have proven woefully inadequate.&#8221;<\/span><\/a><span style=\"font-weight: 400;\"> The Biden campaign has outlined their <\/span><a href=\"https:\/\/joebiden.com\/housing\/\"><span style=\"font-weight: 400;\">plan<\/span><\/a><span style=\"font-weight: 400;\"> to end racist redlining and other unfair practices in the housing market, this includes strengthening and expanding the Community Reinvestment Act.
